Major Bills Advance
The state legislative session wraps up Monday. Yesterday was the last day for the Texas House to give initial approval to Senate bills. While dozens of bills died at the midnight deadline, several priority measures advanced.
On Monday, the House approved Senate Bill 22, which dedicates up to $1.5 billion over the next 10 years to the Texas Moving Image Industry Incentive Program.
Senate Bill 25, dubbed “Make Texas Healthy Again,” was modified before passage by removing high-fructose corn syrup and aspartame from a list of about 50 ingredients that would require warning labels. Dozens of manufacturers—including Texas-based Frito-Lay and Keurig Dr Pepper—lobbied for the change.
The House also passed measures dedicating $1 billion a year to water supply projects and allowing ERCOT to shut off power to large electricity users with a 24-hour notice.
Llano County Library Can Remove Books
A federal appeals court ruled Friday that the Llano County Library is not required to display more than a dozen controversial books that its advisory board removed several years ago. The ruling reversed a lower court’s decision.
In 2021, a group of community members successfully orchestrated the removal of 17 books with sexual or racial themes, prompting other residents to file a lawsuit accusing the county of violating their First Amendment right to free speech.
In the majority opinion from the Fifth Circuit Court of Appeals, Judge Kyle Duncan determined that a library’s curation decisions are a form of government speech and not subject to a First Amendment challenge. “No one is banning (or burning) books,” he wrote.
The ruling is at odds with a decision by the Eighth Circuit Court of Appeals, which ruled last year in a similar case out of Iowa that such a ban does not amount to government speech. The Supreme Court may be asked to resolve the difference.
Texas Monthly Names Top 50 BBQ Joints
Texas Monthly released its latest list of the state’s 50 top barbecue joints yesterday. Seguin’s Burnt Bean Co. took the top spot, and Austin led the way among Texas metros, with eight restaurants making the cut.
Co-founded by Ernest Servantes and Dave Kirkland in 2020, Burnt Bean received high marks for its brisket and Korean beef-back ribs. Two other San Antonio locations—2M Smokehouse and Reese Bros BBQ—also made the list.
Austin’s LeRoy and Lewis Barbecue earned the No. 2 spot, receiving praise for its popular $10 cheeseburger. Another Austin favorite, Interstellar BBQ, landed the No. 6 ranking.
Goldee’s Barbecue in Fort Worth, the No. 1 spot in the 2021 list, fell to No. 3. Nearby Dayne’s Craft Barbecue in Aledo got the No. 7 spot. In Houston, Truth Barbecue came in at No. 9.
The highly anticipated list is only released every four years.
